1. Company Information

Aijungo LLC ("Aijungo," "we," "our," or "us") is a limited liability company organized under the laws of North Carolina, with its principal place of business in Raleigh, North Carolina, USA.

2. Services

Aijungo provides AI-powered business automation systems and related services, including:

• The Aijungo system — an AI automation platform comprising missed call response, lead follow-up, appointment setting, review generation, reactivation campaigns, pipeline tracking, client onboarding automation, and performance reporting
• Smart website design and development
• AI-powered marketing and growth systems
• AI voice and chat bot implementation
• Reputation and community management systems
• Strategy consulting and system configuration

All services are delivered based on the agreed scope in your selected plan or signed service agreement. Aijungo reserves the right to modify, update, or discontinue any service or feature with reasonable notice.

3. Subscriptions and Billing

3a. Monthly Subscriptions

Aijungo offers month-to-month subscription plans. By subscribing, you authorize Aijungo to charge your payment method on a recurring monthly basis on the date you first subscribed.

3b. Annual Plans

Annual plans are billed upfront for 12 months. Annual subscribers receive a discount equivalent to 2 months free. Annual plans are non-refundable after the first 30 days, except as stated in Section 4.

3c. Founding 50 Program

Founding 50 members are locked in at 50% off their selected monthly plan rate for the lifetime of their active subscription. This discount applies only to the base monthly plan and does not apply to setup fees, add-ons, or custom work. The Founding 50 rate is forfeited if the subscription is cancelled and later reinstated.

3d. Setup Fees

Certain plans require a one-time setup fee payable at the time of enrollment. Setup fees are non-refundable as they compensate for work performed during system configuration and onboarding.

3e. Price Changes

Aijungo reserves the right to change subscription pricing. Existing subscribers will receive 30 days' written notice before any price change takes effect. Founding 50 members' locked-in rates are exempt from general price increases for as long as their subscription remains active and in good standing.

3f. Failed Payments

If a payment fails, we will attempt to process it up to three times over seven days. If payment is not resolved within 14 days, your subscription may be suspended or terminated and access to your system may be restricted until the balance is cleared.

4. Refund Policy and 30-Day Guarantee

Aijungo offers a 30-day results guarantee on all monthly subscription plans. If you do not see measurable improvement in lead capture or follow-up performance within 30 days of your system going live, you may request a full refund of your first month's subscription fee.

To request a refund under this guarantee:

• Submit a written request to info@aijungo.com within 30 days of your system launch date
• Include a description of the specific outcomes that were not met
• Refund requests are reviewed within 5 business days

The following are not eligible for refunds:

• Setup fees and one-time configuration charges
• Annual plan payments after the first 30 days
• Subscription fees for months beyond the first 30 days
• Refund requests submitted after the 30-day window
• Cases where system performance was materially affected by client failure to provide required access, credentials, or cooperation

The 30-day guarantee is Aijungo's voluntary commitment to clients. It does not limit or replace any rights you may have under applicable consumer protection law.

5. Cancellation

You may cancel your monthly subscription at any time by contacting info@aijungo.com. Cancellations take effect at the end of your current billing period. You will continue to have access to your system until the end of the period for which you have paid. No partial refunds are issued for unused days in a billing period.

Upon cancellation, Aijungo will retain your system configuration for 30 days in case you choose to reactivate. After 30 days, your configuration may be permanently deleted.

6. Use of Services

You agree to use Aijungo's services only for lawful business purposes. You agree not to:

• Use the services to send spam, unsolicited communications, or deceptive messages
• Violate any applicable federal, state, or local law or regulation, including FTC guidelines on automated marketing and the Telephone Consumer Protection Act (TCPA)
• Misrepresent your business, identity, or the nature of your services to leads or customers
• Use the services to harass, threaten, or defraud any individual
• Attempt to access, reverse engineer, or copy Aijungo's proprietary systems, workflows, or configurations
• Resell, sublicense, or white-label Aijungo's systems without a signed reseller agreement

You are solely responsible for the content of messages sent through your system, including compliance with the TCPA, CAN-SPAM Act, and any applicable state telemarketing laws. Aijungo is not liable for regulatory violations resulting from your use of the system.

7. Client Responsibilities

To ensure successful service delivery, you agree to:

• Provide accurate business information, access credentials, and timely responses during onboarding
• Maintain active accounts on required third-party platforms (including GoHighLevel) necessary for system operation
• Promptly notify Aijungo of any material changes to your business, phone numbers, or service offerings that may affect system performance
• Ensure you have proper authorization to send automated messages to your contact list

8. Intellectual Property

8a. Aijungo's Property

All proprietary automation frameworks, workflow architecture, system designs, website content, branding, and methodologies developed by Aijungo remain the exclusive intellectual property of Aijungo LLC, regardless of whether they are deployed in a client's account. This includes the Aijungo system design and all associated frameworks.

8b. Client Content

Content you provide (logos, brand assets, copy, customer data) remains your property. You grant Aijungo a limited license to use this content solely for the purpose of delivering your services.

8c. Custom Deliverables

For Full Stack or custom-scoped engagements, ownership of bespoke deliverables (such as custom-built websites or unique workflow logic) transfers to the client upon receipt of full payment. Aijungo retains the right to reference the engagement in its portfolio and case studies unless the client requests otherwise in writing.

9. Third-Party Platforms and Services

Aijungo's services are built on and integrated with third-party platforms including GoHighLevel, Make, n8n, Google, Meta, and others. These platforms have their own terms of service, pricing, and policies. Aijungo is not responsible for:

• Outages, downtime, or performance issues on third-party platforms
• Changes to third-party platform pricing, features, or availability
• Loss of data or access resulting from third-party platform decisions
• Compliance failures resulting from changes to third-party platform policies

Clients are responsible for maintaining active and compliant accounts on any required third-party platforms. Aijungo will notify clients of material changes to third-party integrations where reasonably possible.

10. AI and Automation Disclaimer

Aijungo's services use artificial intelligence and automated systems to perform tasks including message generation, call response, and lead follow-up. You acknowledge that:

• AI-generated content may contain errors and should be reviewed periodically
• Automated systems may not perform identically across all use cases or industries
• Aijungo does not guarantee specific business outcomes, revenue results, or lead conversion rates
• System performance depends in part on the quality of your existing leads, market conditions, and factors outside Aijungo's control

11. Disclaimer of Warranties

Services are provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Aijungo does not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Aijungo LLC, its members, managers, employees, and contractors shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages resulting from third-party platform failures or policy changes
• Damages resulting from unauthorized access to your data or system
• Any damages exceeding the total amount paid by you to Aijungo in the three months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Aijungo LLC and its members, managers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the services in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your content or communications sent through the system; or (d) any dispute between you and a third party.

14. Confidentiality

Each party agrees to keep confidential any non-public, proprietary information disclosed by the other party in connection with the services, including system configurations, business strategies, and client data. This obligation survives termination of the service relationship for a period of two years.

15. Termination

Aijungo may suspend or terminate your access to services immediately and without refund if:

• You materially violate these Terms
• You engage in fraudulent, illegal, or abusive activity
• Payment is not resolved within the cure period in Section 3f
• Your use of the system creates legal or regulatory risk for Aijungo

You may terminate your subscription at any time per Section 5. Upon termination for cause by Aijungo, no refunds will be issued.

16. Force Majeure

Aijungo shall not be liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, internet outages, third-party platform failures, government actions, or other events outside Aijungo's reasonable control.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.

Before initiating any legal action, both parties agree to attempt to resolve disputes informally by contacting info@aijungo.com. If informal resolution fails within 30 days, disputes shall be resolved by binding arbitration administered under the rules of the American Arbitration Association in Wake County, North Carolina, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

18. Entire Agreement

These Terms, together with any signed service agreement or order form, constitute the entire agreement between you and Aijungo with respect to the services and supersede all prior agreements, representations, and understandings.

19. Changes to Terms

Aijungo may update these Terms at any time. We will notify active subscribers via email at least 14 days before material changes take effect. Continued use of the services after changes take effect constitutes acceptance of the updated Terms. The most current version will always be available at aijungo.com/terms-and-conditions.
